The Times Kuwait reported on October 14 that authorities will enforce new measures against commercial concealment beginning in February 2027. Decree Law No. 78 of 2026 defines the offense as enabling individuals to conduct business activities they are legally prohibited from undertaking, often through the use of front licenses or to circumvent foreign ownership restrictions. The legislation seeks to eliminate unfair competition and bring all commercial operations into regulatory compliance across multiple sectors.

According to the provisions detailed by Times Kuwait, the decree imposes prison terms of one to three years on offenders along with fines ranging from KD 10,000 to KD 100,000, or the equivalent of any profits earned from the violation, whichever sum is larger. Courts may elect to apply either penalty or both, while the total fine can be multiplied depending on how many people or separate activities are implicated in the scheme. Additional mandatory sanctions include the confiscation of all related profits and equipment, permanent closure of the offending establishment and cancellation of its commercial registration.

Gulf News reported that foreign nationals found guilty must undergo administrative deportation once they complete their prison term. The law further stipulates doubled penalties for anyone who reoffends within five years of a prior final conviction. Legal entities can also be held jointly liable when violations occur for their benefit or with managerial awareness.

Explanations carried by the Times Kuwait indicate that a six-month implementation delay following the law’s publication in the official gazette on August 9 was intended to give businesses time to adjust their structures. During this period, settlement options remain available provided violators pay no less than half the maximum fine, correct the irregularity and restore legal compliance. The framework additionally offers rewards of up to 10 percent of recovered fines to individuals who report such activities.

A Deloitte assessment of the decree notes that inspectors appointed under the law possess judicial authority to demand documents and information from suspected parties. Anyone who impedes these officials, declines to cooperate or supplies misleading data risks up to six months imprisonment and a separate fine not exceeding KD 10,000. The Ministry of Commerce and Industry will oversee the rollout of executive regulations to guide consistent application of the statute.

Reports from Arab Times indicate the legislation builds upon longstanding concerns regarding commercial concealment, known locally as tasattur, which has historically allowed unauthorized operators to dominate certain market segments. The practice distorts market dynamics and undermines efforts to support genuine Kuwaiti entrepreneurship in the commercial sector. Enforcement of the updated rules is expected to reshape business partnerships and licensing arrangements nationwide once the February 2027 deadline arrives.
