Global Regulation Tomorrow detailed in its monthly cross border AML update that the Anti-Money Laundering Authority issued a final report on draft regulatory technical standards for customer due diligence under Article 28(1) of the AML Regulation. The standards specify the information and requirements for standard customer due diligence as well as simplified and enhanced procedures. AMLA conducted a public consultation on an earlier version of the draft from 9 February 2026 to 8 May 2026 and incorporated received feedback where appropriate.

The authority simultaneously published a final report on draft RTS establishing group-wide minimum requirements and additional measures for subsidiaries and branches located in third countries pursuant to AMLR articles 16(4) and 17(3). Structured in five parts, the document addresses scope, identification of the EU parent undertaking in complex structures, policies and controls, information-sharing mechanisms, and non-group structures. These provisions aim to ensure consistent application of anti-money laundering policies across international operations despite varying jurisdictional rules.

A factsheet on legal impediments in third countries accompanies the group-wide RTS and sets out minimum actions, additional risk-mitigating measures, and related supervisory responses. It guides groups on steps required when local laws prevent or restrict compliance with the AMLR or internal policies and controls. The factsheet further explains circumstances in which supplementary measures become necessary if barriers cannot be resolved through customer consent or alternative means.

In a parallel move AMLA finalised standards on home-host supervisory cooperation for cross-border groups operating in both financial and non-financial sectors. The framework creates a shared baseline for information exchange, cross-border inquiries, and coordinated supervision while favouring a proportionate, risk-based approach. Developed jointly with national supervisors, the standards require checking existing data before issuing new requests and promote proactive sharing of relevant information.

These technical standards form part of the broader EU AML package that introduces a single rulebook and centralised supervision, with the AMLR scheduled for full application from July 2027. A parallel update to US information-sharing rules under Section 314(b) of the USA PATRIOT Act, issued by FinCEN in June 2026, reflects similar efforts to facilitate cross-border cooperation against financial crime. Curtis law firm analysis noted that the EU AMLR will introduce comparable partnership mechanisms under Article 75 to enable direct exchanges between obliged entities across member states.

Global Regulation Tomorrow’s monthly cross border AML update positioned the AMLA actions as key steps toward harmonising practices and closing gaps with third-country jurisdictions. The publication observed that addressing legal impediments helps prevent regulatory arbitrage while strengthening overall supervisory coordination. Obliged entities and supervisors are now expected to review the final drafts ahead of their formal adoption by the European Commission.
