Abu Dhabi Court Orders AED50,000 Repayment After Cheque Bounced on Signature Mismatch

The Abu Dhabi Family, Civil and Administrative Court ruled that the defendant must return the full AED50,000 to the plaintiff after the bank rejected the cheque due to a signature that did not match the account specimen, Emirates 24|7 reported. Court records showed the plaintiff had accepted the instrument as settlement for an underlying financial obligation but could not obtain payment when it was presented. The judges required the defendant to cover all associated court fees and expenses as part of the judgment, the newspaper detailed.

Emirates 24|7 said the plaintiff submitted the returned cheque along with the bank’s official memo citing the signature discrepancy as the cause of dishonour. The court determined that this technical issue did not erase the original debt, holding the defendant accountable for fulfilling the commitment through other means if necessary. Legal proceedings revealed that the defendant had not provided alternative repayment despite multiple requests from the claimant.

Federal Decree-Law No. 50 of 2022 on the Commercial Transactions Law treats the intentional creation of a signature mismatch as bad-faith conduct that can carry criminal penalties of six months to two years in prison and fines starting at 10 percent of the cheque value with a minimum of AED5,000, according to an analysis by MIO Law Firm. The 2022 reforms eliminated automatic criminal liability for cheques returned solely due to insufficient funds, reclassifying them as directly enforceable executive instruments that allow creditors to seek payment orders without a full merits trial. This framework balances debtor protections with mechanisms for rapid civil recovery in legitimate disputes.

Central Bank of the UAE circulars indicate that the volume of bounced cheques has declined since the legal changes took effect, yet administrative sanctions persist, including potential two-year bans on new cheque books for individuals after four returns within one year. In Abu Dhabi, civil courts continue to process a consistent number of such recovery actions, reinforcing confidence in cheques for both personal and commercial transactions across the emirate. Creditors are urged to retain all documentation and act within statutory time limits to preserve enforcement rights.

The decision forms part of a pattern of Abu Dhabi rulings that affirm financial obligations even when payment instruments encounter technical failures, as seen in a separate Gulf News report on a Dh4 million investment case where an appeals court upheld repayment after a security cheque was rejected for signature mismatch. Parties involved in similar matters frequently consult legal specialists to distinguish between civil enforcement routes and any potential criminal exposure under the commercial law provisions. Early engagement with the execution court can expedite collection once a judgment is obtained.

Law firms including those publishing practical guides have noted rising client inquiries about cheque disputes in the post-reform era, particularly around the precise definitions of bad faith that trigger criminal complaints. The Central Bank of the UAE maintains oversight to standardise how banks report return reasons and apply related sanctions. This latest Abu Dhabi judgment reiterates that debtors cannot evade liability simply by issuing flawed payment instruments.
