Kuwait Ties Military Service to Employment Under Amended Conscription Law

The Kuwaiti authorities published Decree-Law No. 9 of 2026 in the official gazette Kuwait Al Youm last month tightening rules on compulsory national service that originally took shape under legislation passed in 2015. All male citizens born on or after January 1 2012 must now present themselves to military officials within 180 days of reaching 18 or face legal consequences according to a Gulf News report on the changes. Exemptions cover individuals born before 2012 students at military academies personnel with five or more years in the armed forces police National Guard or fire services and qualifying Kuwait Petroleum Corporation firefighters. Employers must maintain positions salaries and benefits for those called up without duplicating compensation during their period of duty the legislation states.

The National reported that Kuwait reinstated mandatory military service in 2017 after suspending it in 2001 having originally operated the system from independence in 1961 until the early 2000s. Under the updated framework evasion during peacetime draws fines between 1000 and 3000 Kuwaiti dinars while avoiding service past conscription age can lead to two or three years in prison and penalties reaching 5000 dinars. The overhaul also toughens disciplinary measures for absence without leave exceeding five months without justification.

Historical records from War Resisters’ International indicate that Kuwait maintains armed forces of approximately 15300 personnel representing under 1 percent of the national population with around 17600 young men reaching military age annually. Initial rollout of the 2015 law saw only half of the expected 2300 registrants appear in the first two months of the programme prompting repeated calls for stricter enforcement. The latest changes build on that framework by aligning national duty more closely with professional advancement across government and private employment.

Analyses of Gulf conscription patterns published by the Italian Institute for International Political Studies note that Kuwait remains the only state in the region with a sustained mandatory service tradition though compliance has often lagged behind targets. The 2026 decree extends registration timelines from the previous 60-day window while sharpening links between service records and labour market access. Officials framed the package as essential for bolstering defence readiness and closing loopholes exposed during prior enforcement rounds.
