The Al-Shuhoumi Legal Group secured a ruling from Kuwait’s Administrative Court that canceled a Public Authority for Housing Welfare decision ordering the eviction of its clients from a government house in East Taima. Lawyer Abdulkarim Al-Majhoul presented arguments that the authority’s action contravened legal standards governing housing agreements. The court accepted the case and nullified the eviction measure, according to the legal group’s announcement published by Arab Times.

The authority’s disputed decision had called for termination of a rental contract dated June 9, 2021, covering the house occupied by the clients in the East Taima area. PAHW issued the order as part of steps to adjust certain housing arrangements following recent legislative revisions. The legal team maintained that the move lacked proper foundation and represented an overreach of administrative authority.

An Arab Times report from August 4 detailed how the Public Authority for Housing Welfare had notified 509 beneficiaries in East Taima to vacate by September 1 through the Sahel government platform. Those notices implemented Decree Law No. 83 of 2025 repealing Article 29 bis of the Housing Welfare Law, a provision commonly associated with arrangements for citizens who had previously sold their homes. The repeal eliminated earlier safeguards that had permitted continued rental occupancy in such cases.

A separate Administrative Court decision issued on August 21 upheld a comparable PAHW withdrawal of government housing in the same area after determining that occupancy does not create an absolute legal entitlement. That ruling, issued under Counselor Abdulaziz Al-Khayyat, concluded the plaintiff’s basis for challenge had expired with the 2025 legislative change. The authority retained discretion to manage rentals and usufruct arrangements under prevailing statutes.

Arab Times published an editorial on August 17 that welcomed a judicial intervention preventing eviction of families in related housing disputes, citing the need to uphold constitutional protections for legal status and family stability. The commentary referenced the scale of potential displacement involving the 509 East Taima cases and warned against administrative decisions that could conflict with statutory intent. It positioned the judiciary as essential in balancing public interest with individual housing rights.

The Public Authority for Housing Welfare has pursued parallel efforts to expand supply, including a draw conducted on August 20 by its Women’s Housing Affairs Committee that allocated 330 rented units in Taima and Sulaibiya to eligible Kuwaiti women. Committee chairperson Sheikha Bibi Al-Yousef Al-Sabah stated in a press release that the exercise was the largest to date and that the committee has distributed approximately 2,000 homes to Kuwaiti women since its inception. The authority has additionally approved consulting tenders for construction of more than 3,000 new houses in the Salmi area to address overall demand.
