Acas Launches Consultation on Revised Code Promoting Informal Resolution in Workplace Disputes

Acas launched a consultation on 30 July 2026 into its new draft Code of Practice on disciplinary and grievance procedures. This represents the first full revision since the code was last updated in 2009 according to the consultation documents. Acas research places the annual cost of formal disciplinary and grievance procedures at 2.36 billion pounds for UK employers. The draft code emphasises the value of informal resolution through early conversations to address workplace concerns.

The proposed code according to Acas would broaden its application to cover workers in addition to employees. Tribunals would retain the ability to uplift awards by up to 25 percent for noncompliance only in cases involving employees. Employers would need to consider and offer mediation or facilitated conversations with an independent accredited mediator or trained facilitator in appropriate situations. The draft requires employers to document reasons when such measures cannot proceed.

According to the Acas draft code suspension of individuals during investigations would face tighter parameters than before. It should occur only when necessary to meet a legal requirement or to protect the investigation the individuals involved other staff or the organisation’s interests. Any such suspension must be kept as brief as possible and reviewed regularly.

The Acas draft code includes a new section highlighting the duty to make reasonable adjustments and avoid discrimination against workers with disabilities throughout the processes. Examples cited include choosing physically accessible venues for meetings providing documents in suitable formats and allowing support workers or interpreters to attend. Workers receive guidance to submit a short clear written explanation of their grievance that outlines the concern desired outcome and steps already taken informally or reasons none occurred.

In its foreword Acas stated that healthy constructive employment relations can be transformative for individuals and organisations alike. The public consultation on the draft code closes on 23 September 2026. Responses can be submitted via the dedicated Acas consultation portal.
