The Ministry of Human Resources and Emiratisation has begun implementing the revised Wage Protection System effective 1 June 2026 requiring all private sector establishments registered with the authority to disburse wages for the preceding month no later than the first day of each calendar month according to a Gulf News report published on 31 May 2026. Any payment after that date is considered delayed under the new framework introduced by Ministerial Resolution No 340 of 2026 which repeals the prior Ministerial Resolution No 598 of 2022 a Morgan Lewis legal update stated. Salaries must move electronically via the Wage Protection System or other approved channels supported by verification documents while the resolution allows for lawful deductions in calculating the compliance threshold.

Compliance under the resolution is achieved when an establishment transfers at least 85 percent of total wages due by the deadline without affecting any employee’s right to pursue remaining amounts a KPMG flash alert from May 2026 confirmed. The Ministry of Human Resources and Emiratisation developed the updated rules to enhance transparency and strengthen worker protections across the private sector an official platform summary on u.ae noted. Employers remain fully responsible even if they delegate payment processing to third parties according to an EY tax news analysis published on 1 June 2026.

The resolution sets out a graduated enforcement mechanism for delayed payments that begins on the second day after the due date with notifications and alerts issued to noncompliant establishments. By the fifth day authorities suspend new work permits and issue formal warnings while the eleventh day triggers administrative fines under Cabinet Resolution No 21 of 2020 with repeat offenders downgraded to Category Three within a six month window. On the sixteenth day labour disputes register automatically for sites with 25 or more unpaid workers and by the twenty first day the process advances to executive instruments collective disputes precautionary asset attachments travel bans and referral to the Public Prosecution for repeated violations.

The Wage Protection System itself dates back to 2009 when the UAE pioneered its introduction in the GCC region to combat wage delays among migrant workers according to a Global Forum on Migration and Development practice note. An ILO good practice document from 2016 recorded that the electronic transfer requirement rolled out progressively after an initial focus on lower wage employees with oversight shared between what was then the Ministry of Labour and the Central Bank. Subsequent updates including the 2022 resolution refined monitoring but the 2026 version imposes the first truly unified calendar deadline across all covered entities a BDO advisory from 25 May 2026 explained.

More than AED 35 billion flows monthly through the system which covers the vast majority of private sector employees in the UAE one LinkedIn industry analysis referencing official data indicated. The Ministry of Human Resources and Emiratisation has integrated the platform directly with financial institutions to enable real time compliance tracking a Tarmack compliance advisory reported. Certain categories remain outside the scope including workers involved in legal disputes absconding cases unpaid leave and specific sectors such as banks places of worship and select temporary foreign employment arrangements according to the EY summary of the resolution.

Legal firms including Baker McKenzie have advised employers to review payroll calendars immediately to align with the new timelines and prepare supporting documentation for every transfer. The resolution also permits MoHRE to accept alternative approved payment methods provided verification reaches the ministry in full. Establishments that maintained high compliance under previous rules may still need system adjustments to meet the stricter first of month standard without triggering the escalation ladder a Radix HR overview published after the effective date concluded.
