Dubai Enforces New Shared Housing Rules With Mandatory Permits and Stiff Penalties

Law No. 4 of 2026 issued by Sheikh Mohammed bin Rashid Al Maktoum took effect across Dubai including in free zones and special development areas on August 26 exactly 180 days after its publication in the Official Gazette. The legislation defines shared housing as properties where individuals or families occupy designated spaces while using common facilities such as kitchens bathrooms and dining areas and it excludes labour accommodation. Dubai Municipality which oversees implementation has confirmed to Gulf News that the law aims to prevent overcrowding ensure safe conditions promote fair rentals and stabilise the real estate market. The civic body added that general overcrowding inspections have continued without interruption but checks specifically tied to the new permit and compliance requirements will follow an official timeline once procedures are completed.

Existing owners operators and companies received a one-year grace period from the effective date to align their units with the standards and this window can be extended once by decision of the municipality director-general. Dubai Municipality told Gulf News that the grace period itself functions as the warning and regulatory phase before penalties apply. No immediate inspections or evictions under the new rules have begun since the special operating permit process and the Shared Housing Register managed with the Dubai Land Department remain under finalisation. Applications for permits will launch via the municipality’s digital platforms once those steps conclude according to the civic body.

Only property owners or licensed establishments may designate units for shared housing and they must obtain the required permit before leasing. Tenants face an explicit prohibition on subletting any part of a unit with the leasing chain restricted to owner to licensed operator to resident. The law recognises six resident categories including families men women students and employees as well as six eligible property types ranging from apartments and villas to mixed-use buildings and townhouses. All contracts gain legal standing only after registration in the new electronic system which will also track management agreements and resident data.

Dubai Municipality will set specific standards for maximum occupants per unit minimum space per resident and required communal facilities with current building codes already mandating at least five square metres per person in shared accommodation. Rent must be specified in the contract and paid monthly in advance unless otherwise agreed with the amount deemed to cover electricity and water tariffs that the owner settles directly with utilities. Government entities private companies and educational institutions may provide such housing for their affiliates provided they secure licences and meet the approved criteria a framework that builds on prior rules governing residential density.

Penalties for violations start at Dh500 and reach as high as Dh500,000 per offence with the amount doubling for any repeat within one year up to a maximum of Dh1 million. Authorities may suspend operators for up to six months cancel permits withdraw trade licences interrupt utilities or refuse contract registration in non-compliant cases. Evictions require an execution judge’s order and even then residents must receive sufficient time to secure alternative housing rather than facing immediate removal. Full details on violation categories will appear in the law’s forthcoming executive regulations according to Gulf News reporting.

Dubai Land Department figures cited by The National show registered apartment rental contracts climbed from 3,700 in 2015 to 14,900 in 2023 amplifying demand that has fuelled informal sharing. Previous crackdowns included a 2024 sweep that banned 10 owners from leasing over repeated overcrowding and safety breaches with some rooms found holding 14 people in layered bunk beds. A July 2025 fire in a Dubai Marina block housing more than 3,800 residents exposed hazards from illegal partitions The National reported prompting intensified enforcement that the new law now formalises through mandatory permits and occupancy controls.
