UAE Labour Rules Block Employers From Imposing Bans on Valid Job Changes

Workers in the UAE possess the right to change employers according to the provisions of Federal Decree-Law No. 33 of 2021, a Gulf News examination of labour ban rules established on April 11. Employers hold no legal authority to prevent an individual from accepting a new position once contractual obligations are met. Attempts to restrict mobility may involve non-compete language or labour ban requests filed with the Ministry of Human Resources and Emiratisation.

Legal specialist Dr. Hassan Elhais detailed the requirements for a valid non-compete clause during the Gulf News review. Such provisions must be documented in writing, define the restricted profession, confine the period to no more than two years and specify the geographic area. The clause applies exclusively when the work could seriously harm the former employer’s legitimate business interests.

The Labour Law does not specifically provide for any labour ban in cases of non-adherence to non-competition clauses, Elhais said. Disputes over alleged breaches proceed to the judiciary under Article 12 of the Executive Regulations where the employer must demonstrate actual damage. Employees found in violation may owe compensation but face no automatic work permit prohibition from the clause itself.

The Ministry of Human Resources and Emiratisation has confirmed that job transfers occur without a one-year ban when contracts expire naturally or end by mutual consent, according to the same Gulf News article. Bans become possible if a worker departs during probation without observing notice rules or if authorities uphold a work abandonment complaint. These administrative measures operate separately from any contractual non-compete terms, a distinction reinforced in 2026 legal summaries citing Cabinet Resolution No. 1 of 2022.

Analyses published this year by multiple UAE law firms indicate that non-compete restrictions become void if the employer ends the contract unlawfully or without legitimate cause attributable to the employee. Courts possess authority under the Civil Transactions Law effective from June 2026 to modify any penalty amounts to reflect proven losses rather than agreed figures. The ministry maintains that signing a non-compete agreement alone does not activate a labour ban, which stems instead from permit-related violations or unreported absences exceeding statutory thresholds.

MOHRE guidance updated through Ministerial Resolution No. 340 of 2026 provides online tools for contract verification and complaint filing, which must occur within two years of any incident under Article 54 of the labour law. Mediation at ministry centres typically concludes within 14 days with options for amicable settlement, binding decision or court referral. During active disputes workers may receive temporary permits enabling continued employment with the new sponsor pending resolution.
