Lawyer Muhammad Al-Bathari detailed the background of the case in an account published by Arab Times. One of his clients had entered into a marriage contract with a Chinese national in the People’s Republic of China before the couple sought to complete authentication procedures with Kuwaiti officials upon their return. The application met with rejection based on two key observations concerning the contract, specifically the lack of a marriage guardian and inconsistencies in the listed date.

The husband subsequently pursued judicial recourse to establish the marital relationship and activate its legal consequences after administrative avenues closed. His legal representatives lodged a lawsuit that requested formal court confirmation of the union. The court examined the evidence presented and delivered a verdict upholding the claimant’s position.

According to the ruling outlined by Al-Bathari in the Arab Times report, the court affirmed that the marriage between the claimant and the first defendant took place on March 20, 2023 with an agreed dowry of 200 Kuwaiti dinars. The decision further required the parties to undertake the necessary steps to obtain an official authentication certificate from the Sharia Documentation Department. This directive extends to the enforcement of all attendant legal effects stemming from the recognized marriage.

The verdict clarifies that an administrative inability to authenticate a foreign marriage contract does not foreclose judicial remedies, Al-Bathari explained through the Arab Times coverage. Such decisions enable couples to secure domestic legal standing despite initial procedural setbacks encountered at government offices. The outcome provides a pathway for the recognition of valid overseas contracts within Kuwait’s personal status framework.

Al-Rai daily figures show that marriages between Kuwaiti men and Asian women reached 16 cases in the first five months of 2025. The tally reflected a decline from 36 such unions recorded during the equivalent period in 2024. These statistics illustrate shifting patterns in cross-nationality marriages amid broader demographic trends tracked by Kuwaiti authorities.

A bilateral agreement signed in 2007 between Kuwait and China addresses judicial assistance in civil and commercial matters including personal status issues, according to the treaty published by China’s International Commercial Court. The pact supports mutual recognition of qualifying judgments between the two countries. In the present case the couple obtained confirmation through Kuwaiti courts rather than invoking the treaty provisions directly.
